Scope of Work:
Task 1: Analysis and reporting
The expert will complete an assessment of Libyan legislation related to status of migrants (including irregular migrants) and asylum seekers, in light of international law applicable to Libya and best international practices. The expert will review the relevant legislation, regulations, and policies on the status of migrants and asylum seekers, and analyze them in light of the following three questions:
In addition, the expert will be provided with a detailed list of issues to analyze specific to the area of law. The expert will prepare the analysis in the form of a narrative report, which will include the recommendations as described below.
Task 2: Recommendations
Expert will be responsible for articulating recommendations to improve the legal framework related to the status of migrants (including irregular migrants) and asylum seekers in Libya and including these recommendations in the report. Recommendations should be aimed at achieving the following goals:
Task 3. Facilitation of a technical assistance workshop
The expert shall facilitate a Technical Assistance workshop for Libyan justice sector and other relevant officials that will provide the participants with international and comparative analysis and best practices on the status of migrants and asylum seekers, and their application in Libya. The expert will also assist participants in analysing the strengths and weaknesses of the Libyan system and coming up with a road map for improvement. The workshop will take place in Tunis, Tunisia, and will include relevant Libyan stakeholders. The expert will be expected to travel to Tunis, Tunisia, and to create a post-workshop report, per specifications from ABA ROLI.
